Personal-Use Image Licence Terms

These terms govern your purchase of a digital image file from this photographer through Happy Apple. By completing a purchase you agree to the terms below.

1. Product Summary

You are purchasing a non-exclusive personal-use licence to a single digital image file. The photographer retains copyright and all ownership rights.

2. Licence Granted

On full payment you receive a non-exclusive, non-transferable, perpetual licence to use the purchased image for personal, non-commercial purposes. Territory: worldwide. Duration: perpetual. This licence covers digital and print use for personal display only.

3. Permitted Uses

You may:

Print the image for personal display in your home or office
Use the image on your personal website or social media accounts
Share the image with friends and family
Make reasonable personal copies for backup purposes

4. Prohibited Uses

You may not:

Use the image for any commercial purpose, including advertising, marketing, merchandise, or client work
Resell, redistribute, or sublicence the image file
Upload the image to stock libraries or similar platforms
Use the image as a trademark, logo, or brand element
Use the image to train artificial intelligence systems
Use the image in any way that is unlawful, defamatory, misleading, or offensive
Use the image beyond the scope of this personal-use licence

5. Attribution

Attribution is not required but is appreciated. If you do credit the photographer, please use their name and a link to their Happy Apple profile.

6. Model and Property Releases

Where model or property releases have been obtained, this is noted in the image listing. If a release is not noted, the image may not be suitable for uses that require one. You are responsible for obtaining any additional permissions needed for your specific intended use.

7. Editing and Alterations

You may crop, resize, apply filters to, and incorporate the image into personal projects. You may not alter the image in a way that is derogatory, misleading, or that falsely attributes the work to another person.

8. Delivery and Downloads

Files are delivered digitally in JPEG or WebP format at the resolution you purchased. Downloads are available via your order history for 30 days after purchase. If your file is inaccessible or damaged, contact legal@happyapple.co.nz for a replacement.

9. Refunds

Because digital image files are delivered immediately and cannot be returned, all sales are final and non-refundable except where required by the New Zealand Consumer Guarantees Act 1993. Chargebacks raised without a legitimate basis may result in account suspension.

10. Customer Responsibilities

You must:

Use the image within the scope of this licence
Not remove or circumvent watermarks on preview images before purchase
Keep your proof of purchase and a copy of these licence terms
Not claim authorship or copyright ownership of the image

11. Photographer-Specific Terms

These terms are set by the individual photographer and may be updated from time to time. Platform terms of use also apply. Where these terms conflict with platform terms, platform terms prevail except where these terms grant you broader rights.

12. Warranty and Limitation

The photographer warrants they have the right to licence this image but makes no guarantee that it is suitable for every intended use — that assessment is your responsibility. The photographer's liability is limited to the amount you paid for the image. Nothing in these terms limits rights that cannot be excluded under New Zealand law.

14. Governing Law

These terms are governed by the laws of New Zealand.
